What is Pre-filing Community Accountability Diversion (CAD)
Pre-filing diversion is a program for adult misdemeanor offenders. As soon as a misdemeanor charge is presented to the District Attorney's office the case is screened for suitability for the pre-filing program. Offenders are referred by the District Attorney’s Office after review but prior to criminal charges being filed.
The program affords the offenders the opportunity of handling their cases outside of a court of law. Offenders receive referrals to mental health, employment, and education services, as well as other beneficial community resources. The intended result is that the client gains access to services that help them live law-abiding lives. A successful completion of the program results in a recommendation for non-filing of criminal charges.
Who is eligible?
There are two criteria which need to be met:
The offender must be a first time offenders or offenders with "minimal criminal history".
The crime committed must be qualifying for the program.

How to apply?
The program is a pre-filing program. The cases are screened prior to charges being filed. There is no need to apply for the program. The program will be offered for selected cases.
What happens in the program?
If your case has been deemed suitable for pre-filing diversion, you will be contacted by CorrectiveSolutions, both via phone and letter. In this communication, a case manager will explain the process.
You enroll in the program by completing a Diversion Plan Conference (over the phone) and paying an enrollment fee of $40.
The Diversion Plan Conference is a customized Diversion Plan established for you. The Diversion Plan which will be emailed to you following your enrollment contains the conditions that you must meet in order to successfully complete the Diversion. Conditions may include class attendance, community service, drug testing and referrals to community resources.
The Program length is typically two to four (2-4) months depending on charges and conditions and starts upon enrollment (day of your Diversion Plan Conference).
You must contact the Program once a month. The schedule for those contacts will be included in your Diversion Plan.
NOTE: Most cases will still show a charge on the record, but will be dismissed if/when the case gets the correct input by the court.
